By accessing or using Stormi AI ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use our Service.

Stormi AI is an AI-powered Instagram DM automation platform designed for fitness coaches. Our Service:

• Automatically responds to Instagram Direct Messages using AI
• Qualifies leads based on your specified criteria
• Books appointments on your connected calendar
• Provides analytics and conversation management tools

3. AI Automation Disclosure

IMPORTANT: By using Stormi AI, you acknowledge and agree that:

• AI-Generated Responses: Messages sent through your Instagram account are generated by artificial intelligence, not written by you directly.
• Your Responsibility: You are responsible for all content sent through your Instagram account via our Service, even though it is AI-generated.
• Platform Compliance: You must ensure your use of AI automation complies with Instagram's Terms of Service and Community Guidelines.
• Disclosure Recommendation: We recommend informing your leads that initial responses may be automated if required by applicable laws.

4. Account Requirements

To use Stormi AI, you must:

• Be at least 18 years of age
• Have a valid Instagram Business or Creator account
• Have authority to bind any business entity you represent
• Provide accurate and complete registration information
• Maintain the security of your account credentials

5. Acceptable Use Policy

You agree NOT to use Stormi AI to:

• Send spam, unsolicited messages, or bulk promotional content
• Harass, threaten, or abuse any individuals
• Distribute malicious, deceptive, or fraudulent content
• Violate Instagram's Terms of Service or Community Guidelines
• Impersonate others or misrepresent your identity
• Engage in illegal activities or promote illegal products/services
• Collect or harvest user data without consent
• Interfere with or disrupt our Service or servers
• Attempt to gain unauthorized access to our systems

Violation of this policy may result in immediate account termination.

6. Instagram and Meta Platform Compliance

By connecting your Instagram account, you agree to:

• Comply with Meta's Platform Terms and Developer Policies
• Grant us only the permissions necessary to provide our Service
• Accept that Meta may revoke access at any time
• Acknowledge that disruptions to Meta's services may affect our Service

7. Payment and Subscription

Subscription terms:

• Subscription fees are billed in advance on a monthly or annual basis
• All fees are non-refundable except as required by law
• Prices may change with 30 days notice
• You authorize us to charge your payment method automatically
• Failure to pay may result in service suspension or termination

8. Intellectual Property

Our Property: The Service, including its design, features, AI models, and content, is owned by Stormi AI and protected by intellectual property laws.

Your Content: You retain ownership of your content (coach profiles, qualification criteria, etc.). By using our Service, you grant us a license to use your content solely to provide the Service.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• No Warranty: The Service is provided "AS IS" without warranties of any kind, express or implied.
• AI Limitations: We do not guarantee the accuracy, appropriateness, or effectiveness of AI-generated responses.
• No Guarantee of Results: We do not guarantee any specific business outcomes, leads, or bookings.
• Liability Cap: Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.
• No Consequential Damages: We are not liable for indirect, incidental, special, or consequential damages.

10. Indemnification

You agree to indemnify and hold harmless Stormi AI, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) content sent through your connected Instagram account.

11. Termination

By You: You may terminate your account at any time through your dashboard settings or by contacting us.

By Us: We may suspend or terminate your account immediately if you violate these Terms, fail to pay fees, or engage in conduct harmful to our Service or other users.

Effect of Termination: Upon termination, your right to use the Service ceases. We may delete your data in accordance with our Privacy Policy.

12. Service Availability

We strive for high availability but do not guarantee uninterrupted service. The Service may be temporarily unavailable due to:

• Scheduled maintenance (with advance notice when possible)
• Emergency repairs or updates
• Third-party service disruptions (Instagram, Anthropic, etc.)
• Events beyond our reasonable control

13. Modifications to Service and Terms

Service Changes: We reserve the right to modify, suspend, or discontinue any part of the Service at any time.

Terms Changes: We may update these Terms from time to time. Material changes will be communicated via email or through the Service. Continued use after changes constitutes acceptance.

14. Dispute Resolution

Any disputes arising from these Terms or the Service shall be:

• First attempted to be resolved through good-faith negotiation
• Subject to binding arbitration if negotiation fails
• Governed by the laws of Delaware, USA
• Brought only in courts located in Delaware for non-arbitrable claims

15. General Provisions

• Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Stormi AI.
• Severability: If any provision is found unenforceable, the remaining provisions remain in effect.
• No Waiver: Failure to enforce any right does not waive that right.
• Assignment: You may not assign your rights without our consent. We may assign our rights freely.
